TERMS OF USE

Please read these Terms of Use and our Privacy Policy carefully before using the SIGHTER app. By accessing or using the app, you agree to be bound by these Terms and Conditions and agree to our Privacy Policy.

As part of the SIGHTER swarm you should be prepared to receive UAP alerts at any time of day or night. Depending on your situation, this may or may not be convenient or acceptable to you. The SIGHTER mission depends on your commitment and  willingness to participate in UAP sightings whenever they occur within your alert radius. If this is not an acceptable condition of use, please set your SIGHTER notifications to “off”, or your alert sound for SIGHTER in your smartphone’s settings to “off”.

Grant of Rights: By using the SIGHTER app, you grant SIGHTER non-exclusive, worldwide, royalty-free rights to use the data captured by you through the app, including visual images, video, audio and sighting metadata. These rights allow SIGHTER to reproduce, distribute, display, and utilize the captured data for research, education, and advancing the goals of SIGHTER, including promoting and distributing the SIGHTER app through any means it may deem appropriate to those ends.

Data Storage and Release: SIGHTER does not retain sighting images or metadata on your local device once they are uploaded to SIGHTER servers. However, you have the option to request the image data captured by you. It is important to understand that there may be limitations on releasing visual data, and SIGHTER is currently developing policies in this regard.

User Anonymity: SIGHTER maintains strict user anonymity. When utilizing the captured data for reproduction, distribution, display, or any other purpose, SIGHTER will not attribute the video or photographic images or associated metadata to you as the SIGHTER user. This includes refraining from using any identifying information you may have provided to SIGHTER, such as location information, email address, or other associated details. However, please note that certain identifying information that unavoidably accompanies the recorded UAP images, such as personal characteristics, notable landmarks or environmental features, may indirectly reveal your location and possible identity at the time of recording.

Indemnity: You agree to indemnify and hold SIGHTER harmless from any claims or liabilities arising from your use of the app and the data captured and uploaded or distributed, electronically or otherwise.

Policy Modifications: The granted usage rights described herein remain in effect unless otherwise specified. SIGHTER reserves the right to modify this policy at its discretion, providing prior notification of any changes.

Prohibition of Faked Sighting Data: SIGHTER strictly prohibits the creation and dissemination of deliberate false positive UAP sightings or the issuance of false or prankish alerts. We uphold the highest standards of integrity and accuracy in collecting and distributing UAP data. Any attempts to manipulate, falsify, artificially create, or misrepresent visual data undermine the authenticity and credibility of the app and the mission of SIGHTER.

SIGHTER understands and has accounted for the fact that inadvertent false positive sightings will occur due to the nature of detecting and visually recording UAP. However, SIGHTER aims to discourage the intentional creation of false positive sightings or deliberately issuing false alerts.

Detection of False Positive Sightings: SIGHTER employs various methods, processes, and analytical tools, such as user polling and cross-referencing of metadata from multiple sighting participants, to detect both inadvertent and deliberately created false positive sightings and false alerts. These measures help us differentiate between accidental and deliberate fakery, ensuring the authenticity and credibility of the captured data. Users found to have deliberately created false sightings or issued false alerts may be prohibited from engaging in future sightings or uploading data to SIGHTER servers.

Recourse for Fakery: In the event of the detection of indisputable fakery, including the intentional creation or manipulation of data, while attributing such visual data to SIGHTER or the SIGHTER app, SIGHTER reserves the right to pursue all available means to seek recourse for any damages incurred as a result. This may include initiating civil litigation, seeking compensation for reputational harm, or exploring other legal remedies permitted by applicable laws.

Changes to Terms and Conditions: SIGHTER reserves the right to change or modify these terms and conditions at any time, with prior notice to users. By continuing to use the app after receiving notice of the changes, you acknowledge and agree to abide by the updated terms and conditions. It is your responsibility to regularly review the terms and conditions to stay informed of any modifications. Failure to comply with the revised terms and conditions may result in the termination of your access to the app.

SIGHTER will provide notice of any changes to the terms of use through appropriate means, such as email notifications, in-app notifications, or postings on the SIGHTER website. It is advisable to keep your contact information up to date to ensure you receive timely notifications regarding any updates to the terms and conditions.

If you do not agree with the modified terms and conditions, you have the right to discontinue using the app. Your continued use of the app following the notification of changes constitutes your acceptance of the updated terms and conditions.
